Kambah man to face court over online child sex offences

A 56-year-old Kambah man will face the ACT Magistrates Court today (Friday, 15 January 2021) charged with a number of online child sex offences.

As part of an ACT Joint Anti Child Exploitation Team (ACT JACET) led investigation, police yesterday executed a search warrant at a residence in Kambah.

During this activity, police allegedly discovered an expansion drive containing video and image files depicting child abuse material. This drive was seized and will undergo further digital forensic analysis.

Police further allege the man is himself depicted in one of the videos engaging in a sex act while viewing ‘live’ child abuse material. 

The man was arrested, and has been charged with one count of using a carriage service to engage in sexual activity with a child under 16 years of age, and two counts of possession of child abuse material.

Use of term ‘CHILD ABUSE’ MATERIAL NOT ‘CHILD PORNOGRAPHY’

The correct legal term is Child Abuse Material – the move to this wording was among amendments to Commonwealth legislation in 2019 to more accurately reflect the gravity of the crimes and the harm inflicted on victims.

Use of the phrase "child pornography" is inaccurate and benefits child sex abusers because it:

  • indicates legitimacy and compliance on the part of the victim and therefore legality on the part of the abuser; and
  • conjures images of children posing in 'provocative' positions, rather than suffering horrific abuse.

Every photograph or video captures an actual situation where a child has been abused.
