One driver, two drink driving charges, seven offences

A 22-year-old man from the suburb of Ngunnawal will answer to seven charges after police detected him drink-driving twice in a little more than three hours on Saturday (10 December, 2022).

About 2.05am police observed a black BMW323i on Gundaroo Drive, Nicholls, which accelerated away from the officers, changing lanes several times without indicating before stopping a short time later in a car park near Gungahlin Drive.

Police will allege the man, who was in the driver’s seat, claimed he was not driving and initially refused to provide police with his details.

Police checks revealed the man’s licence had been suspended in March 2022, meaning he was subject to a zero Blood Alcohol Content (BAC) limit, and that he was also the subject of a Good Behaviour Order.

In a roadside test, the man recorded a positive result for alcohol, and subsequent analysis at Gungahlin Police Station revealed a BAC of 0.135.

The man was served with an Immediate Suspension Notice (ISN), suspending his licence for 90 days, and further reminded of the suspension when he was released from custody.

About 5.10am, police observed the same black BMW from the earlier incident turn from Gundaroo Drive into Gungahlin Drive without indicating, and directed the vehicle to stop, which it did on Gamburra Street, Ngunnawal.

When police approached the vehicle, they observed the driver was the only person in the vehicle. After the man again returned a positive roadside result for alcohol, he was taken into custody and subjected to breath analysis at Gungahlin Police Station, where he recorded a BAC of 0.081.

The man has been charged with two counts of level three drink driving, aggravated reckless driving, failing to comply with a police request to produce personal information, driving while suspended by law, driving while suspension notice in effect, and breach of good behaviour order.
